Paper details
This paper should be focus on the international law of territorial right of seas which is currently regulating the issues of
South China Sea dispute (to put it simple, several countries in the area (like China, vietnam) have different opinions on how
the south china sea should be allocated as their own national territory). The south china sea is important for those countries
because of its crude oil reserve, military importance, shipping route…..
In this paper, I don’t need you to explain what is South China sea and discuss why it is important and who should be
entitled to this area. The main focus of this paper should be
(1) the moral justification or flaws in the law regulating the territorial right of seas/water in this area. such as : United Nations
Convention on the Law of the Sea.
(2)in your opinion, is the current international law of territorial right of sea perfect enough for the current situations in South
China Sea? (of course you can expand to all the sea dispute around the world) what is the flaws and merits in the current
international law of sea
(3) in order to solve the problems such as the South China Sea dispute, what kind of international law do we need? (you
can purpose new laws or make adjustments on teh existing law) (please use examples from South China Sea and
territorial sea disputes in other places) (it would be better if the examples are more focused on the South China Sea
dispute)
(4) why the law you purposed/adjusted is better than the current law? (mainly the moral justification of your proposal, you
can include some economic or political justification, too) (if you are not familiar with the economic aspects, I can write the
economic part : )
(5) possible objections to your arguments and possible rebuttal to those objections (if you do not want to do this part, you
can skip it.)
here are some useful sources:
http://opil.ouplaw.com/ the front page is right now introducing the South China Sea disputes. you can find a lot of free
resources on this matter.
http://www.unesco.org/csi/act/russia/legalpro6.htm it is brief introduction of maritime law (noth national and international)
you can find the history of the laws of territory right of seas. How the United nations developed it and what it is like right
now.
I will also provide some articles on territorial rights and legitimacy of international law.
Those resources are not required for this paper. I think read through them might be helpful.
The audience of this paper is familiar with philosophical, political, economic and legal terms. You don’t need to explain
those terms thoroughly. The main focus should be on your argument
